AN ORDINANCE AMENDING SECTION 123.01 (a), OF THE MANTUA CODE OF ORDINANCES, TO REVISE WHERE LEGISLATION AND COUNCIL NOTICES ARE TO BE PUBLICLY POSTED, AND DECLARING AN EMERGENCY

WHEREAS, Section 123.01 (a) of the Mantua Code of Ordinances sets forth the public locations where ordinances and resolutions are to be posted; and

WHEREAS, Village Council has determined that the current locations do not provide a maximum of access to these items for the public; and

WHEREAS, Village Council desires to modify these locations, so as to provide greater public access to this information;

NOW, THEREFORE, BE IT ORDAINED by the Council for the Village of Mantua, County of Portage, State of Ohio, that:

Section 1. Section 123.01 (a) of the Mantua Code of Ordinances, previously adopted by this Council, shall be amended and modified as follows:

123.01 POSTING OF LEGISLATION.

  1. Under the provisions of Oho R. C. 731.25, the Clerk-Treasurer is hereby directed to post copies of all ordinances and resolutions required to be posted or published in the following five most public places within the Village, to-wit:

    1. At the Mantua Police Department;
    2. At Middlefield Bank;
    3. At the United States Post Office;
    4. At the Mantua Station Drug Store; and
    5. On the Village website - @ mantuavillage.com

Section 2. is hereby found and determined that all formal actions of this Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and of any of its Committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.

Section 3. This Ordinance is hereby declared to be an emergency measure necessary for the preservation of the public peace, health and safety of this municipality and for the further reason that Council modify these posting locations at the earliest possible opportunity. Wherefore, provided it receives the affirmative vote of five or more of the members elected or appointed to this Council, this Ordinance shall take effect and be in force immediately upon its passage by Council and approval of the Mayor; otherwise, it shall take effect and be in force from and after the earliest time allowed by law.
