AN ORDINANCE APPROVING THE OLD FIRE STATION PURCHASE AGREEMENT BETWEEN THE VILLAGE OF MANTUA AND THE MANTUA TOWNSHIP TRUSTEES, BOTH GOVERNMENTAL ENTITIES, FOR THE SUM OF ONE HUNDRED FORTY-FIVE THOUSAND DOLLARS ($145,000.00) UPON THE TERMS OUTLINED IN THE ATTACHED AGREEMENT, DETERMINING THE EXISTENCE OF A REAL AND PRESENT EMERGENCY, AUTHORIZING THE MAYOR, THE VILLAGE CLERK-TREASURER AND THE VILLAGE ADMINISTRATOR TO ENTER INTO AN AGREEMENT TO THIS EFFECT, AND DECLARING AN EMERGENCY

WHEREAS, the Village of Mantua has a need for a new government center, as the current village hall is in desperate need for repair; and

WHEREAS, the Village is concluding an agreement relationship with the Mantua Township Trustees who have a building available for purchase currently, which formerly served as the Mantua-Shalersville District Fire Station; and

WHEREAS, Mantua Village Council wishes to authorize the purchase agreement for the “Old Fire Station”, a copy of which is attached hereto, and authorize the Mayor, Village Clerk-Treasurer and Village Administrator to take all steps necessary to enter into this agreement;

NOW, THEREFORE, BE IT ORDAINED by the Council for the Village of Mantua, County of Portage, State of Ohio, that:

Section 1. Village Council hereby approves the Old Fire Station Purchase Agreement between the Village of Mantua and the Mantua Township Trustees and further authorizes the Village Mayor, the Village Clerk-Treasurer and the Village Administrator to execute the documents necessary to conclude and execute this agreement.

Section 2. Village Council determines that a real and present emergency necessitating this purchase exists as the current Village Hall is in immediate need of significant, costly repair, and the Old Fire Station will only be available for purchase for a limited period of time.

Section 3. It is hereby found and determined that all formal actions of this Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and of any of its Committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.

Section 4. This Ordinance is hereby declared to be an emergency measure necessary for the preservation of the public peace, health and safety of this municipality and for the further reasons stated above in Section 2. Wherefore, provided it receives the affirmative vote of five or more of the members elected or appointed to this Council, this Ordinance shall take effect and be in force immediately upon its passage by Council and approval of the Mayor; otherwise, it shall take effect and be in force from and after the earliest time allowed by law.
